    What is a foreclosure — and why you will rarely see one in Ontario

    A true foreclosure is a court process in which the lender takes ownership of the home and any remaining equity along with it. In Ontario, that process is slow and rare — lenders almost always use a power of sale instead. Under a power of sale, the lender sells the home on the owner's behalf, recovers the mortgage debt and selling costs, and returns any surplus to the borrower. The outcome for buyers is the same as the "foreclosure deal" they were searching for: a lender-driven sale, usually priced to move.

    Other provinces work differently. British Columbia, Alberta, Saskatchewan, Manitoba and Nova Scotia rely on court-supervised judicial sales and foreclosures, and Quebec has its own hypothecary process.     Buying a power of sale or foreclosure property

    These homes are usually sold "as is, where is" — the lender has never lived in the property and makes no warranties, so budget for an inspection and possible repairs. Closing timelines and conditions tend to be stricter, and well-priced listings attract serious competition.     Are there real foreclosures in Ontario?

    Almost never. Ontario lenders use the power of sale process, which lets them sell the property without taking ownership. True court-ordered foreclosures are common in provinces like British Columbia and Alberta, but in Ontario the listings buyers call foreclosures are nearly always power of sale properties.

    How do I know if a listing is a power of sale?

    The listing description will usually say power of sale or note that the mortgagee — the lender — is the seller. That is exactly how this page finds its listings: it collects every active listing whose description identifies the sale that way, and filters out listings that state they are not a power of sale.

    Are foreclosure and power of sale homes cheaper?

    Not automatically. The lender has a legal duty to seek fair market value, but it is also motivated to sell quickly, so pricing is often sharp and homes may need work.
