These Terms & Conditions ("Terms") govern your use of PropertyMesh.ca (the "Site") and our services. By using the Site, you agree to these Terms. PropertyMesh.ca is wholly owned by Faiza Ahmed Realty Corporation and operates under INTERNATIONAL REALTY FIRM, INC., Brokerage (RECO #4799095).
"Services" means Site content, tools, calculators, lead forms, VOW data feeds, and connections to licensed REALTORS®.
"You" or "User" or "Consumer" means any person accessing or using the Site.
"VOW Data" means the real estate listing data provided via the Virtual Office Website feed matching the RESO Web API standards from PropTx Innovations Inc. / TRREB.
Website pages and lead forms are advertising under Ontario rules. We identify our brokerage as above. Verify any registrant on the RECO Public Register. Not intended to solicit consumers currently under contract with another brokerage.
A Member's VOW must obtain the identity of each Consumer and obtain each
Consumer's agreement to Terms of Use of the VOW, as follows:
(a) Consumers must provide their name and a valid email address. The Member must send an email to the address provided by the Consumer confirming that the Consumer has agreed to the Terms of Use (described in paragraph 7(c) below). The Consumer may be permitted to access the VOW only after the Member has verified that the email address provided is valid and that the Consumer agreed to the Terms of Use.
(b) The Consumer must supply a username and a password, the combination of which must be different from those of all other Consumers on the VOW, before being permitted to search and retrieve Listing Information via the VOW. The username and password may be established by the Consumer or may be supplied by the Member, at the option of the Member. An email address may be associated with only one username and password. Consumers' passwords may be valid for up to 90 days, after which such passwords must be renewed or reconfirmed. The Member must, at all times, maintain a record of the name and email address supplied by the Consumer, and the username and current password of each Consumer. Such records must be kept for not less than 180 days after the expiration of the validity of the Consumer's password. If PropTx has reason to believe that a Member's VOW has been the cause of, or permitted a breach in, the security of the MLS® data or a violation of this VOW Policy, or the MLS® Rules and Policies (including the VOW Rules) related to use by one or more Consumers, the Member shall, upon request of PropTx, provide to PropTx a copy of the record of the name, email address, username, current password, and audit trail, if required, of any Consumer identified by PropTx to be suspected of involvement in the breach or violation.
(c) The Consumer must be required to affirmatively express agreement to a "Terms of Use" agreement that requires the Consumer to open and review an agreement that provides at least the following:
(i) That the Consumer acknowledges entering into a lawful broker- consumer relationship with the Member.
(ii) That all MLS® data obtained from the VOW is intended only for the Consumer's personal, non-commercial use.
(iii) That the Consumer has a bona fide interest in the purchase, sale, or lease of real estate of the type being offered through the VOW.
(iv) That the Consumer will not copy, redistribute, retransmit, or otherwise use any of the data or Listing Information provided, except in connection with the Consumer's consideration of the purchase, sale, or lease of an individual property.
(v) That the Consumer acknowledges PropTx' s ownership of, and the validity of PropTx's proprietary rights and copyright in the MLS® database, MLS® data, PropTx's MLS® System, and Listing Information.
(vi) That the Consumer will not, directly or indirectly, display, post, disseminate, distribute, publish, broadcast, transfer, sell or sublicense any Listing Information to another individual or entity. The prohibited uses expressly include "scraping" (including "screen scraping" and "database scraping"), "data mining" or any other activity intended to collect, store, re-organize, summarize or manipulate any Listing Information or any related data.
(vii) After the Consumer has opened for viewing the Terms of Use agreement, a "mouse click" is sufficient to acknowledge agreement to those terms. The Terms of Use agreement may not impose a financial obligation on the Consumer or create any representation agreement between the Consumer and the Member.
(viii) The Terms of Use agreement shall also expressly authorize PropTx, and other PropTx Members or their duly authorized representatives, to access the VOW for the purposes of verifying compliance with MLS® Rules and Policies (including the VOW Rules) and monitoring the display of Members' Listings by the VOW.
(ix) Every VOW must display a privacy policy that boldly informs Consumers of, and obtains Consumers' consent to, all the ways in which Personal Information that they provide may be collected, used or disclosed, including the fact that Personal Information may be shared with PropTx for auditing and/or legal purposes.
The Site is for personal, non-commercial use only. You will not, directly or indirectly, display, post, disseminate, distribute, publish, broadcast, transfer, sell or sublicense any Listing Information or data obtained through the VOW to another individual or entity.
Prohibited actions explicitly include:
Scraping, crawling, harvesting, downloading, or mimicking content, listings, or board data via automated methods (including "screen scraping," "database scraping," bots, or "data mining").
Reverse engineering, decompiling, reverse assembling, or attempting to extract source code from the Site.
Using the Site to build a competitive product, or sharing your VOW credentials with any third party.
Circumventing security controls, or parsing fields for commercial exploitation.
We reserve the right to immediately track, limit, suspend, or terminate access for any user account exhibiting suspicious or commercial data activity.
By providing contact details, you agree we may send service/transactional messages (e.g., account confirmations, password resets, document requests). Marketing CEMs are sent only with valid consent (express or implied) under Canada's Anti-Spam Legislation (CASL). Each CEM will identify us and include a working unsubscribe; we will process unsubscribe requests within 10 business days.
All Site content and UI elements (text, graphics, logos, calculators, design architectures, code) are owned by PropertyMesh or our licensors. We grant you a limited, revocable, non-exclusive license to access and personally use the Site.
TRREB / PropTx: You expressly acknowledge PropTx Innovations Inc.'s and the Toronto Regional Real Estate Board's (TRREB) absolute ownership of, and the validity of TRREB's proprietary rights and copyright in, the MLS® database, TRREB's MLS® System, TRREB's listing information, and any related data.
ITSO: You acknowledge the Information Technology Systems Ontario (ITSO) ownership of and validity of ITSO's copyrights in the MLS® System data.
CREA Trademarks: The trademarks REALTOR®, REALTORS®, and the REALTOR® logo are certification marks owned by REALTOR® Canada Inc. and licensed exclusively to The Canadian Real Estate Association (CREA). The MLS®, Multiple Listing Service®, and DDF® marks identify the quality of services provided by REALTORS® who are members of CREA.
Data display on the VOW is based in whole or in part on information provided by other members of the Real Estate Boards who remain responsible for its accuracy. The Real Estate Boards reproduce and distribute this information as a service and assume no responsibility for its accuracy. All data provided via the VOW is deemed reliable but is not guaranteed accurate by PropTx Innovations Inc. or the Site.
Listing Brokerage Prominence: The listing brokerage of any property on this site will be clearly identified in all views and will not be visually separated, obscured, or diminished in font size/color relative to other listing details.
Separate Member Info: The contact details for PropertyMesh or its individual agents will be displayed clearly separated from any individual listing parameters not belonging directly to International Realty Firm, Inc.
No Modification: Listings transmitted through the VOW Data Feed will not be changed, altered, or manipulated from the exact payload delivered via the API. No historical data prior to the year 2003 will be requested or displayed.
Seller Privacy Flags: Where a seller has directed a brokerage to withhold their listing or property address from display on the internet, the fields will map strictly to security compliance instructions. If the Display Address on Internet (disp_addr) flag is set to No (N), the address, street number, name, postal code, and unit details will remain hidden.
Some articles or pages (e.g., regarding Flat Fee performance) may cite research from US-based entities (such as Bright MLS). While these studies illustrate general economic principles of MLS® exposure, market dynamics in Ontario may differ. These statistics are provided for illustrative purposes only.
Our calculators and tools are informational only; outputs are estimates and not guaranteed. They are not financial, legal, investment, or tax advice. Verify results independently or with licensed professionals.
All real estate services are provided through International Realty Firm, Inc. In Toronto, Faiza Ahmed services clients directly. In the event of her unavailability in Toronto, or for services required in other cities (including but not limited to Markham, Hamilton, Durham Region, and Waterloo), you are matched only with licensed REALTORS® whose licensing status, performance metrics, and neighbourhood specialization have been verified. All matched partners are contractually obligated to adhere to the PropertyMesh pricing model & registered with International Realty Firm, Inc.
While we offer differing fee structures (Tier 1 vs. Tier 2), "Discount" refers only to the price you pay, not the legal protection you receive. Under Ontario law (TRESA) and RECO regulations, fiduciary duties are not sliding scales. A REALTOR® charging a flat fee is bound by the exact same Code of Ethics as one charging a percentage. Specifically, regardless of the tier selected, we owe you: Undivided Loyalty, Confidentiality, and Full Disclosure.
Services and fees are defined in your Listing Agreement. The Site describes our standard packages as follows:
Tier #1 (Flat-Fee Full-Service REALTOR® — Listing Side): $5,000 fixed fee. Includes MLS® listing, photography, staging consultation, and negotiation/closing support.
Tier #2 (Premium Full-Service REALTOR® — 1% Listing): Available when the list price in the Listing Agreement is $1,200,000 or higher. For properties under $1,200,000, Tier 2 commission will be 1.25% or higher, as agreed in writing. For Tier 2 the commission is always calculated as a percentage of the final sale price. Includes all Tier #1 services plus enhanced preparation services along with professional staging and open house.
Tier #3 (Mere Posting): $1,499 fee. Seller manages showings and negotiations; Brokerage provides MLS® system access only.
Cooperating Brokerage Compensation: Functions as a market access incentive offered by the Seller. You are not paying the cooperating brokerage to represent you; you are paying to access the network of buyers they represent.
Listing Activation Deposit: A $500 listing deposit is payable to International Realty Firm, Inc., Brokerage at the time of listing for Tier 1 and Tier 2 full-service packages. If a transaction closes, it is credited toward commission; if it does not sell or expires, the deposit is retained by the brokerage to offset direct marketing, MLS®, and admin costs.
Promotional Offers: Conditional promotions (e.g., "Sell for 0%") require concurrent purchase actions of a specific value within a set timeframe as formalized in a written Representation Agreement.
Buyer Cash-Back: Typically 1.0%–1.5% of purchase price, specified in writing before (or at) signing a Buyer Representation Agreement (BRA); paid/credited on closing, subject to lender approval and applicable law.
Our Privacy Policy outlines how we comply with the Personal Information Protection and Electronic Documents Act (PIPEDA).
Board Authorization: You explicitly authorize PropTx Innovations Inc., TRREB, and their designated regulatory representatives to access any personal or account metadata you provide to the Site for the strict purpose of auditing, verifying regulatory compliance, and monitoring enforcement of VOW rules.
Right to Erasure: If you issue a formal request to remove your Personal Information from our VOW platforms, we will comply instantly and notify the corresponding listing brokerage and PropTx admin to flags or decouple data pipelines from internet rendering matrices where legally required.
No Advice: All content is general information. We do not provide legal, financial, tax, or investment advice. Verify all material facts independently.
Third Parties: Third-party sites are provided for convenience. We do not endorse or assume liability for their content, practices, or accuracy.
As-Is Basis: The Site and VOW Services are provided "as is" and "as available" with all faults. PropertyMesh disclaims all legal warranties to the maximum extent permitted by law.
Liability Cap: Our total liability under any action or theory is limited strictly to the lesser of CAD $500 or the fees you paid to us in the preceding 12 months.
You agree to defend, indemnify, and hold harmless PropertyMesh, International Realty Firm, Inc., and our respective officers and affiliates from any claims, damages, losses, fines, penalties, or expenses (including reasonable legal fees) arising from your use of the Site, your input of User Data, your violation of any third-party rights (including intellectual property), or your breach of these compliance-driven VOW Terms.
These Terms are governed by the laws of Ontario, Canada. Disputes will be resolved by binding arbitration under the rules of the ADR Institute of Ontario, in Toronto, Canada. Each party bears its own costs unless the arbitrator orders otherwise. Nothing prevents either party from seeking injunctive relief in a court of competent jurisdiction regarding intellectual property or security breaches.
We reserve the right to modify these Terms to accommodate evolving technical standards or board rules. Material changes will be posted directly to this page with an updated "Last Updated" date. Continued usage of the secure VOW layers following updates constitutes binding agreement to the amended parameters.
