These Terms & Conditions (“Terms”) govern your use of PropertyMesh.ca (the “Site”) and our services. By using the Site, you agree to these Terms.
PropertyMesh.ca is wholly owned by Faiza Ahmed Realty Corporation and operates under INTERNATIONAL REALTY FIRM, INC., Brokerage (RECO #4799095).
1) Definitions
- “Services” means Site content, tools, calculators, lead forms, and connections to licensed REALTORS®.
- “You” or “User” means any person accessing or using the Site.
2) Brokerage identification & compliance
Website pages and lead forms are advertising under Ontario rules. We identify our brokerage as above. Verify any registrant on the RECO Public Register. Not intended to solicit consumers currently under contract with another brokerage.
3) Personal use; acceptable use
The Site is for personal, non-commercial use. You agree not to:
- scrape, crawl, harvest, or bulk-download content, listings, or builder/board data;
- use bots or automated methods to access, interfere with, or overload the Site;
- reverse engineer, decompile, or create derivative works from the Site or its tools;
- circumvent security or access controls;
- use the Site to violate law or others’ rights (privacy, IP, contractual, or property rights).
We may suspend or block access for violations.
3.1 Electronic communications & CASL
By providing contact details, you agree we may send service/transactional messages (e.g., confirmations, document requests). Marketing CEMs are sent only with valid consent (express or implied) under Canada’s Anti-Spam Legislation (CASL). Each CEM will identify us and include a working unsubscribe; we will process unsubscribe requests within 10 business days and maintain consent records.
You agree not to add PropertyMesh email addresses or phone numbers to your own CEM distributions without valid consent under CASL. Nothing in these Terms limits your statutory rights.
4) Intellectual property
All Site content and UI (text, graphics, logos, calculators, code) are owned by PropertyMesh or our licensors. We grant you a limited, revocable, non-exclusive license to access and personally use the Site. Any reproduction, republication, scraping, framing, resale, or derivative works require prior written consent.
5) Content sources; trademarks; listing data; foreign statistics
- Builder & community data: Sourced from builder feeds, public sources, and REALTOR® contributions; deemed reliable but not guaranteed.
- Foreign Market Data: Some articles or pages (e.g., regarding Flat Fee performance) may cite research from US-based entities (such as Bright MLS). While these studies illustrate general economic principles of MLS® exposure, market dynamics in Ontario may differ. These statistics are provided for illustrative purposes only.
- Trademarks: REALTOR®, REALTORS®, MLS®, Multiple Listing Service®, and DDF® are owned by or licensed to CREA; other marks belong to their owners.
- Board/IDX feeds: Information may be based in whole or in part on data from CREA’s DDF® and/or local real-estate boards.
6) Tools & calculators
Our calculators and tools are informational only; outputs are estimates and not guaranteed. They are not financial, legal, investment, or tax advice. Verify results independently or with licensed professionals.
7) Service Delivery, Fiduciary Standards & Fees
7.1 Service Fulfillment & Partner Verification
All real estate services are provided through International Realty Firm, Inc. In Toronto, Faiza Ahmed services clients directly. In the event of her unavailability in Toronto, or for services required in other cities (including but not limited to Markham, Hamilton, Durham Region, and Waterloo), you are matched only with licensed REALTORS® whose licensing status, performance metrics, and neighbourhood specialization have been verified. All matched partners are contractually obligated to adhere to the PropertyMesh pricing model & registered with International Realty Firm, Inc.
7.2 Fiduciary Duties & The “Discount” Model
While we offer differing fee structures (Tier 1 vs. Tier 2), “Discount” refers only to the price you pay, not the legal protection you receive. Under Ontario law (TRESA) and RECO regulations, fiduciary duties are not sliding scales. A REALTOR® charging a flat fee is bound by the exact same Code of Ethics as one charging a percentage. Specifically, regardless of the tier selected, we owe you:
- Undivided Loyalty: We must promote and protect your best interests above all others.
- Confidentiality: Your motivations and bottom line remain strictly private.
- Full Disclosure: We must reveal all relevant facts that affect your transaction.
7.3 Service Tiers & Commissions
Services and fees are defined in your Listing Agreement. The Site describes our standard packages as follows:
- Tier #1 (Flat-Fee Full-Service REALTOR® (Listing Side)): $5,000 fixed fee. Includes MLS® listing, photography, staging consultation, and negotiation/closing support.
- Tier #2 (Premium Full-Service REALTOR® (1% Listing)): Available when the list price in the Listing Agreement is $1,200,000 or higher. For properties under $1,200,000, Tier 2 commission will be 1.25% or higher, as agreed in writing. For Tier 2 the commission is always calculated as a percentage of the final sale price.
- Inclusions: Includes all Tier #1 services plus enhanced preparation services (which may include professional cleaning, and furniture moving assistance) along with professional staging and open house (subject to mutual agreement in Listing Strategy).
- Tier #3 (Mere Posting): $1,499 fee. Seller manages showings and negotiations; Brokerage provides MLS® system access only.
- Cooperating Brokerage Compensation (Market Access): While legally termed “compensation” on OREA forms, this amount functions as a market access incentive offered by the Seller.
- Listing Commission: Pays for your representation, marketing, and strategy (Service).
- Cooperating Commission: Incentivizes other brokerages to introduce their buyer clients to your property (Access).
You are not paying the cooperating brokerage to represent you; you are paying to access the network of buyers they represent.
- Listing Activation Deposit: A $500 listing deposit is payable to International Realty Firm, Inc., Brokerage at the time of listing for Tier 1 and Tier 2 full-service packages. If a transaction closes under the Listing Agreement, this deposit is credited toward the commission payable on closing. If the property does not sell, or if the Listing Agreement is cancelled or expires without a completed transaction, the deposit is retained by the brokerage to partially offset direct marketing, MLS®, and administrative costs. Full details are set out in your signed Listing Agreement and may vary slightly by package or market.
7.4 Promotional Offers (e.g., “Sell for 0%”)
We may offer conditional promotions, such as “0% Listing Commission” when you also purchase a home with us.
- Eligibility: These offers differ by region and property value and are subject to the terms of a written Representation Agreement.
- Conditions: Typically requires a concurrent purchase of a specific value within a set timeframe. If the purchase condition is not met, standard commission rates (Tier 1 or Tier 2) may apply.
7.5 Buyer Cash-Back
Typically 1.0%–1.5% of purchase price, specified in writing before (or at) signing a Buyer Representation Agreement (BRA); paid/credited on closing. Subject to lender approval and applicable law.
8) No advice; independent verification
All Site content is general information. We do not provide legal, financial, tax, or investment advice. Property details, availability, pricing, incentives, and fees change frequently; verify with the listing brokerage, builder, and relevant professionals.
9) Third-party links & services
Third-party sites and services are provided for convenience and do not imply endorsement. We are not responsible for their content, availability, or practices.
10) Disclaimers & limitation of liability
The Site and Services are provided “as is” and “as available.” To the maximum extent permitted by law, PropertyMesh and its affiliates are not liable for any indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, or business, arising from or related to your use of (or inability to use) the Site or Services, even if advised of the possibility.
11) Indemnity
You agree to indemnify and hold harmless PropertyMesh and its affiliates from claims and expenses (including reasonable legal fees) arising from your misuse of the Site, violation of these Terms, or infringement of third-party rights.
12) Privacy
Our Privacy Policy explains how we collect, use, disclose, and safeguard personal information. By using the Site, you also agree to the Privacy Policy.
13) Governing law & dispute resolution
These Terms are governed by the laws of Ontario, Canada. Disputes will be resolved by arbitration under the rules of the ADR Institute of Canada, Inc., seated in Toronto, Ontario. The arbitrator’s decision is final and binding.
Nothing restricts your right to bring a complaint to RECO or other competent regulators.
14) Changes to the Site & Terms
We may update the Site and these Terms from time to time. Material changes will be posted on this page (see “Updated” date). Continued use signifies acceptance of the updated Terms.
